IP Consulting article in ECTA magazine

The article is a presentation of the trademark opposition system in Bulgaria – four years after its implementation, for the readers of ECTA magazine.
Both authors are Bulgarian and European trademark attorneys.
The magazine is publication of the European Community Trade marks association – ECTA which represents the European trademark attorneys.
The article in ECTA magazine points out some particularities of the trade mark opposition system in Bulgaria. Also trademark a brief paralell with the trade mark opposition system for registration of Community trademarks before the OHIM.
According to the Bulgarian Law on Marks and Geographical Indications, oppositions may be filed by:
- the holder of an earlier trademark;
- exclusive licensees of earlier marks;
- owners of non-registered marks used in commercial activity within Bulgaria (but already applied for registration); or
- holders of marks applied for by an agent or representative of the holder.
